3. Our Role Under Data Protection Law
One of the most important aspects of this Privacy Policy is understanding who controls your information.
OwambeOS operates as a multi-tenant Software-as-a-Service (SaaS) platform.
Depending on how you interact with the Platform, Bridgepoint may act as either:
- Data Controller;
- Joint Controller; or
- Data Processor.
3.1 Bridgepoint as Data Controller
Bridgepoint acts as the Data Controller where we determine why and how personal information is processed.
Examples include:
- creating user accounts;
- maintaining platform security;
- billing and subscriptions;
- fraud prevention;
- product analytics;
- customer support;
- platform improvement;
- regulatory compliance;
- legal obligations;
- marketing where permitted.
3.2 Event Planners as Independent Data Controllers
When an Event Planner creates an event and uploads guest information, the Event Planner determines:
- which guests are invited;
- what information is collected;
- who receives communications;
- seating arrangements;
- event access;
- attendance policies;
- guest permissions.
In these circumstances, the Event Planner is the Data Controller under applicable data protection law.
Bridgepoint merely provides the technology platform.
3.3 Bridgepoint as Data Processor
Where Bridgepoint processes guest information solely on behalf of an Event Planner, Bridgepoint acts as a Data Processor.
In such circumstances we process information only:
- on documented instructions from the Event Planner;
- for providing the contracted services;
- to maintain security;
- to comply with applicable law.
Bridgepoint does not independently determine the purposes for processing guest information belonging to Event Planners except where required by law or necessary for platform security.
3.4 Corporate Customers
Corporate organisations using OwambeOS to manage conferences, employee events, awards, activations or other programmes generally act as Data Controllers in relation to participant information.
Bridgepoint acts as their technology provider and processor unless otherwise agreed.
3.5 Vendors
Vendors using OwambeOS manage their own customer relationships.
Bridgepoint controls information relating to platform accounts, while vendors remain responsible for personal information they independently collect outside the Platform.
